1. Data Controller & Applicable Law

The data controller is Philipp Frei, Schlossbergstr. 11, CH-8590 Romanshorn, Switzerland. This privacy policy complies with the Swiss DSG (Datenschutzgesetz) and, where applicable, the EU GDPR.

2. Information We Collect

Account: Email address, display name, password (bcrypt-hashed, never stored in plain text), account creation date.

Conversations: Chat messages are stored server-side to provide conversation history. Messages are processed by third-party AI providers (e.g. OpenAI) to generate responses — only message content is sent, no personal identifiers.

Payments: Payment processing is handled entirely by PayPal. We only store the PayPal subscription ID. No credit card or bank details are stored.

3. Legal Basis (GDPR Art. 6)

Processing is based on: contract performance (account & subscription), legitimate interest (platform security, fraud prevention).

4. Third-Party Processors

PayPal (Europe): Payment processing. Subject to PayPal Privacy Policy.
OpenAI (USA): AI chat processing (message content only). Subject to OpenAI Privacy Policy. Data transfer to USA based on Standard Contractual Clauses (Art. 46 GDPR).

5. Data Retention

Account data is retained until you delete your account. Subscription data is retained for 7 years after end of subscription (legal requirements). Messages are deleted when you delete your account.

6. Cookies

We use only technically necessary cookies (authentication token). No tracking or advertising cookies.

7. Your Rights (GDPR Art. 15–22)

You have the right to access, rectify, erase, and port your data, as well as restrict or object to processing. To exercise these rights, contact contact@aestheticdreams.net.
